Did you have the sandbox enabled? To obtain an accurate leak test result, you must disable the sandbox.

On VMWare machine with Windows XP SP3 and CIS 5.8.199581.2037 BETA, with sandbox disabled, proactive security, d+ safe mode, firewall safe mode. All other settings were default.
I scored 340/340.
I have not tested this Beta on Windows 7.
Explorer as parent:

You did not answer my question: Do you have the sandbox enabled?
To obtain an accurate leak test result, you must disable the sandbox.

1.CIS v5.5 → pass all tests
2.CIS v5.8 beta → fail two tests of them

As Whoop-dee-doo has mentioned twice now, the sandbox must be disabled…
Please follow the advice in the link he has also posted twice to get accurate leak test results.
