Can that be considered as the initial protection from execution, or is it somehow related with controlling explorer.exe and not the malware samples?
It is the nitial protection from execution, malware being executed by you( explorer).

Try with CIS 3.9 RC2. We have fixed some issues that caused CIS to fail.
